Regulations for Use

Regulations for Use of the University of St.Gallen Library of 29 June 1999.

The University of St.Gallen Senate Committee has approved these regulations, based on Art. 75, Par. 1 (i) of the University Statutes of 3 November 1997:

I. General rules

Art. 1.
These statutes regulate:

a) general regulations for the use of the Library;
b) use in the Library;
c) borrowing.

By using the Library of the University of St. Gallen (HSG-Library), users accept these statutes.

Art. 2.
The HSG-Library is a publicly accessible academic special library. It collects, catalogues and supplies information media in the subject areas which are taught at the university, and preserves them for the future. In particular, it serves teaching and research at the university as well as other scientific work, further education and information.

It extends its services by participating in local, national, and international information exchange.

Art. 3. 
Persons aged 14 years and over are permitted to use the Library.

Art. 4.
Use of the Library's facilities on its premises is generally permitted. Persons under 14 years of age have access to the Library only if they are accompanied by an adult.

Art. 5.
Those permitted to borrow media are : all natural persons who are residents in or have a study place in Switzerland or in the Euregio Lake Constance (rural district of Constance, district of Lake of Constance, rural districts of Sigmaringen (Pfullendorf area only), Ravensburg, Lindau, province of Vorarlberg, principality of Liechtenstein) as well as members of the universities of the IBH-Union. Furthermore, all libraries which participate in the Swiss and international inter-library loan system are permitted to borrow media.

Other natural persons and legal entities should apply to the Library management for borrowing rights.

Art. 6.
A person authorised to borrow from the Library is given a borrower's card. As proof of identity an identity card with valid address is sufficient. For HSG students, their student card also serves as a borrower's card.

In order to be admitted to the premises of the Library, minors who are neither secondary nor tertiary students need a borrower's card, which is issued only with the written consent of the parents or the legal representative.

The borrower's card can be issued for a fixed period and is not transferable.

Art. 7 .
The library is to be informed immediately of any change of name or address. Moreover, through a mail redirection order (with post office or landlord) or other appropriate measures it must be guaranteed that notifications sent by the Library reach the addressee.

If the borrower's card is lost, the Library must be notified immediately, so that the card can be cancelled. If a new card is issued, the old one is no longer valid.
If misuse is suspected, the borrower's card can be withheld temporarily.

Art. 8.
The University Council regulates the fees for the use of the Library's services.

Art. 9.
The following personal data are stored electronically by the Library or - in the case of members of the university - are transmitted to the Library by data transfer: surname, first name, date of birth, address, telephone numbers, e-mail address, student number, user group. Through the online catalogue, all users have access to the data stored about them at any time.

If required, the data can be used by all libraries of IDS (German-Swiss Information Network). If a Library user, violates the Library regulations in a particularly serious way, the Library management is authorized – in order to protect other libraries – to inform them about this, stating the reasons why they took this measure.

The names and addresses of persons who have borrowed documents are not disclosed to other users. Exceptions can be made by the Library management.

The data are treated according to the rules of the Data Protection Ordinance of the canton of St. Gallen.

Art. 10.
The Library, consonant with its duties and responsibilities, and insofar as its personal resources permit, supplies oral and written information.

The Library can procure information from online databases.

Art. 11.
The opening hours are fixed by the Administrative Director of the University on the advise of the Library management.

Art. 12.
Photocopying machines are available in the Library.

Photographs or other copies made from works held by the Library can be produced or duplicated for commercial purposes if express permission is obtained from the Library management.

Art. 13.
Coats, umbrellas, briefcases, rucksacks, bags and animals as well as larger items may not be taken into the Library. Outside the Library, a cloakroom and lockers are available. The Library management issues guidelines for the use of the lockers.

In all areas of the Library, silence is to be observed. Eating, drinking, smoking as well as the use of mobile phones are prohibited in the Library. The Library stock and all equipment and furnishings are to be treated with care.

The making of underlinings and notes as well as the causing of any form of change or damage to documents and other information carriers are forbidden. The documents and other information media which have been used in the Library are to be deposited on the sorting shelf or handed back to the circulation desk immediately after use. After use, journals must be reshelved at their appropriate location. Users are responsible for clearing their Library seat daily before they finally leave the Library. The Library management is authorized to issue special regulations for authors of HSG dissertations and HSG diploma theses.

Library seat cannot be reserved. Authors of HSG dissertations, who work in the Library for at least 3 days per week, are allowed to reserve a seat with a lockable small cupboard. A record is kept of their attendance. The Library management can allocate given seats for use or close them off. For certain parts of the collection and for certain methods of working (e.g. working with a laptop), the Library can prescribe use in assigned areas.

Art. 14.
Users are liable for any loss or damage which the Library suffers, be this to documents in use or on loan, or through violation of user regulations. Equally, they are liable for any damage which the Library suffers through abuse of a borrower's card by a third party. They also bear any administrative expenses arising from this for the Library.

The condition of Library material issued to users must be examined and existing damage pointed out immediately. If users report no damage, then this means that they have received the material in perfect condition.

Their legal representatives will be held liable for any damage caused by under-age users.

Art. 15.
The Library is not liable for objects which users bring with them into the Library.

It accepts no responsibility for the correctness and completeness of information, data and information media. Any liability arising from their use is explicitly excluded. Users themselves are responsible for the observance of copyright law.

Art. 16.
Users who gravely or repeatedly violate the Library regulations or otherwise through their behaviour make the continuance of the user relationship unreasonable can be excluded by the Library management from use of the Library in whole or in part, for a limited or unlimited period of time. All obligations resulting from the user relationship remain in force even after the exclusion.

At the request of the Library management, the Rector can apply for disciplinary action to be initiated against members of the University.

The University reserves the right to prosecute.

Art. 17.
The Library has the right to inspect the contents of briefcases, bags and similar containers and to demand proof of identity from all users.

Art. 18.
The HSG Library must be supplied with a copy of all bibliographically independent works and of all component parts of bibliographically independent works published by the HSG, by Faculty, by academic staff members of HSG research institutes as well as by candidates for a doctoral degree or a habilitation.

If delivery of a deposit copy is impossible or cannot reasonably be expected (e.g. examiner’s report, high costs), the Library must nonetheless be informed about date and place of publication and source of supply.

If two or more copies of a bibliographically independent publication are deposited, one copy is displayed in the showcase for faculty publications in the Library building. The Library regulates the display in the showcase.

Art. 19.
Any person is entitled to suggest books and other media to the Library for acquisition.

II. Use in the Library
Art. 20.
The Library's opens access collection and the publicly available information services can be used without any formalities on the premises of the Library.

Art. 21.
Parts of the Library's collection, even individual works, can be declared reference holdings (rarity value, protection and preservation, permanent accessibility). In principle, such works are only to be used on the Library premises. Applications for exceptions to be granted can be made to the Library management.

Art. 22.
Holdings which are kept in closed-access (e.g. rare books, archival materials, CD-ROMs, HSG diploma theses) may be used only on the Library premises. During the use of such materials, the borrower’s card or an official identity card can be demanded as security deposit.

No access of any kind is permitted to HSG diploma theses which are classified as confidential or which have been rejected.

Art. 23.
With the consent of the Library management, members of the Faculty of the University are entitled to assemble documents for a reserve collection on the premises of the Library for the duration of their semester courses. In general, the Faculty concerned are responsible for their contents and for their updating.

III. Borrowing

Art. 24.
All documents in the Library, which are not subject to borrowing restrictions can be borrowed for use outside the Library. Presentation of a valid Library card confers the right to borrow such documents.

It is not permitted to remove Library materials from the Library which have not been duly checked out. All documents in the Library are protected by an electronic security system. If a document is not correctly registered and deactivated, the Library staff will be alerted by an acoustic signal.

Subject to the obtaining of special permission from the Library management, works can be borrowed for exhibition purposes. In special cases, the Library management is entitled to allow further exceptions to the current borrowing regulations.

Art. 25.
On receipt of a written request, the Library can send loanable documents to registered users. In principle, documents are not sent to persons with a residential address in the town of St. Gallen.

The Library can restrict the postal service for operational reasons or in the case of works which are unsuitable for transport (e.g. oversize documents, fragile data carriers).

Art. 26.
Works which are available neither in the libraries of the German-Swiss Information Network (IDS) nor in other libraries open to the public in St. Gallen, can be ordered from external libraries.

Copies of articles can be ordered independently on the user's own responsibility and at his/her expense from libraries or commercial document suppliers. The addresses of recommended suppliers are listed on the homepage of the HSG Library.

Art. 27.
Documents on loan are to be returned by the expiry of the loan period and, if recalled, during the extension period. Overdue notices and recall notices are to be complied with within the prescribed time limit.

In urgent cases the Library reserves the right to recall documents before the expiry of the regular loan period.

The date of return, is defined as the day on which the loaned document arrives back in the Library.

Art. 28.
Users who do not return borrowed documents on time will be sent a reminder by the Library.

If overdue notices are not complied with or charges owing are not paid, the Library has the right to refuse the loan of further documents.

If the document on loan is not returned after the third overdue notice, the Library is authorized – after a reasonable length of time – to purchase a replacement at the user’s expense or to demand compensation for its replacement value.

Art. 29.
Users can reserve documents on loan using the online catalogue. They will be notified by the Library as soon as the reserved document is available for collection. If a reserved document is not collected within the fixed time limit, the Library can dispose of it otherwise.

The Library can restrict the number of reservations.

Reservations of several identical copies and reservations of items which one already has on loan are not permitted.

In exceptional circumstances, the Library can arrange for a special reservation which has priority over existing reservations.

Art. 30.
Before their status-as borrowers is terminated, users are obliged to return all borrowed documents and their Library card and to pay outstanding fines.

Students have to return all documents they have borrowed before leaving the University. The Library confirms the discharge.

Art. 31.
On application by the Library management, the University's Administration can regulate further details in the borrowing regulations.

IV. Legal protection
Art. 32. 
Orders issued on the basis of these regulations can be challenged within 14 days by appeal to the Executive Committee of the University Senate.

Appeal against an Executive Committee decision can be made within 14 days to the University Council.

The rules of the law governing the administration of justice in appeal cases are applicable.

V. Final provisions
Art. 33.
The University Administration can – on application by the Library management - issue regulations implementing these statutes.

Art. 34.
The Library statutes of 22 January 1979 and the regulations governing execution of the Library statutes of 14 November 1989 are cancelled.

Art. 35.
These statutes come into force on 1 October 1999.
